Whether or not you have a case is the first question that must be addressed in most circumstances.  Laws in British Columbia come from both written laws (statutes), as well as judge made laws (common law), which are unfamiliar to many people.  This question requires a determination of substantive issues such as whether you have suffered losses or damages as the result of someone else’s unlawful actions.  In addition, in order to answer the question, it is also necessary to consider procedural issues, such as whether the claim is brought within the time proscribed by law for such a claim (which is also known as the limitation period).  A third issue to be considered in answering this question is what losses or damages have been suffered.
